Grounds for Uncontested Divorce
In Pennsylvania, both fault-based and no-fault grounds are recognized. The fault-based grounds for divorce include adultery, domestic violence, cruel treatment, bigamy, imprisonment for at least two years, willful abandonment for at least one year, and abusive conduct which makes a marriage unbearable.
The no-fault grounds for divorce are mutual consent (90 days must elapse from the date of commencement of action) and irretrievable breakdown of the marriage (the parties must live separate and apart for at least two years before filing).
